Mapture considers your privacy one of its highest priorities. Because our apps and services rely on location data to provide core functionality we want you to know we will never sell or give your data to third parties, such as advertisers. There are some cases where we will share data and those are clearly disclosed in this document.
This privacy policy describes how we obtain, store and provide information via our applications, services and documentation. Collectively, these are referred to as the “Services”.
By using the Services, you consent to use of your Personal Information as described in this policy. If you are under the age of 13 you may not use or register for the Services. If you are not of legal age to form a binding contract (in most jurisdictions, 18 or older) you may use the Services and share your Personal Information with us only with the express consent of a parent or legal guardian. Except as described in this Privacy Policy, your Personal Information will not be used for any purpose other than providing functionality to you and specific individuals or organizations approved by you, e.g. sharing your name and location while an application is in use with your partners. We do not collect data to sell customer lists. You may withdraw your consent to our use of your information. However, this may result in reduced or no functionality.
When registering or signing up to use the Services, you may be required to provide personal contact information, such as your name, organization, email and address.
If we sell you Services directly, i.e. not via a vendor such as Apple’s App Store or Google Play, we may require you to provide billing information at the time of purchase. We do not, however, retain this data ourselves, only using a PCI-compliant payments processor.
Collectively, this data is considered “Personal Contact Information”.
When using the Services, GPS (global positioning system) or similar technology may be used to determine your location. This data may contain, but is not limited to, latitude, longitude and altitude accurate to within 1 meter, and other attributes, such as date and time, rate of motion and direction. Such data may include, but is not limited to, waypoints, tracks and routes. You may choose to turn off location tracking via mechanisms provided with the Services or, in the case of Applications, within device settings. Doing so will impact functionality within the Services.
We minimize the use and collection of location data, using only what is deemed necessary to provide functionality. For example, while it is possible, we will never ask for “Always” location access for our iOS application (which means the application is capable of tracking you without your initiating an operation, such as recording a track).
Collectively, this data is considered “Locational Information”.
Any data that you choose to share with others, such as your current location, waypoints, tracks or images, will be considered “Public Data”. Further dissemination is beyond our control. Data that you do not choose to share with others is considered “Private Data”.
We use login credentials or security tokens from third-party authentication services. Tokens and cookies may be used within the Services to facilitate authentication and ease of use.
You are also responsible for protecting your Login Information. For example, do not share your login credentials. Safeguard your username and password when using the Services, so others will not have access to your “Personal Information”.
Collectively, this data is considered “Login Information”.
When you use our Services, we may collect and retain information via cookies, log files and other means, including device and browser types, operating system (OS), and IP address. We also may collect and retain information related to user interaction, such as which web pages are viewed, areal extent of map views, links followed and services accessed. In the event of technical errors, we may automatically receive reports that contain information related to operating system (OS) version, device type, application version or browser version. This data will be anonymized. You may also voluntarily submit reports, e.g. crash data, either via mechanisms provided by us in the Services or by other means, such as email. Such reports may be associated with you and your “Personal Contact Information”.
Collectively, this data is considered “Usage, Diagnostic and Analytical Information”.
Location data is provided by your device when you consent to our mobile or web application’s (“app”) request to use location data. In the case of a mobile (native) app it is stored internally in the app and is accessible only within that app. Data created by you, such as photos, text entries, diagrams, waypoints, tracks or routes, is also stored internally and is only accessible within the app on the device. Your data may in whole, or in part, and primarily based on your actions, such as saving or naming it, be transmitted securely via our Services, where it is securely stored within servers and databases controlled and administered by us.
We use this information for account management, verifying identity, providing Services, internal customer lists, security and fraud detection, and may – in a limited manner – contact you occasionally for marketing purposes, such as subscription specials. You may opt out of any marketing communications by emailing [email protected] from the email account associated with your Mapture account.
Billing-related information is used to manage your account, to collect payment (such as for subscriptions), and provide Services (particularly those dependent upon paid subscriptions). Transaction processing is handled by a PCI-compliant third party vendor, which is not allowed to use, store or retain Billing Information except for the sole purpose of processing payments (typically via credit card) on our behalf.
We may use your personal information to send important notices, such as communications about changes to our terms, conditions and policies. Because these communications are vital to your interaction with our Services, you may not opt out of them.
We may use your location information to make personalized recommendations (such as the location of nearby natural features or points of interest) and anonymized to provide us with analytical data important to maintaining and improving our Services. (See Section 3.c for additional use of locational data in conjunction with other data and in relation to the distinction between “Private Data” and “Public Data”).
We use your “Private Data” to provide you with a means to catalog and display locational, visual/audio, and textual data for your personal use. It is not shared with any other party, although we may – via anonymization techniques – use if for internal analysis to maintain and improve our Services.
“Public Data” covers both data that you share with selected others and data that you intentionally share without regard to who might see it. In either case, you must assume that the recipient of data you share may share it with others – a factor beyond our control. However, we do not share your data outside the scope you choose. In other words, if you choose to share your location with three hiking partners, they will be the only parties outside of you and Mapture that will see it. We may use such data solely for analytical purposes to maintain and improve our Services. Again, it is important for you to remember that any recipient you choose to share data with may pass it along to others.
In some cases, you may elect to share “Public Data” more broadly. For example, you may choose to publish a route for a hiking trail and make it available to any other user of our Services. In such cases, you must consider this data permanently outside your control.
This information is used by us to authenticate you, determine your eligibility to view or use certain portions of our Services or Content, to prevent fraud or abuse, and to retrieve and deliver to you data that either you have created and stored or that has been shared with you by others.
We use this data to maintain and improve our Services. We may use anonymized data to analyze and diagnose Services. In some cases, anonymized data may be shared with a third party for analytical purposes but will not include personal or locational data.
In addition to the description of how we may use your data of each type, we may also disclose your Personal Information as follows:
a. When legally required to do so (e.g., to cooperate with law enforcement or other legal proceedings); and/or
b. If we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personal data may be among the assets transferred.
No Transmission of data over the internet can be completely secure and we cannot ensure that your Personal Information will never be disclosed in ways not otherwise described by this Policy.
You may access or change your information or delete your account within the Services at any time by contacting us at [email protected]. Please note that copies of information that you have updated, changed or deleted may remain viewable in cached and archived pages of the Services for a period of time.
We will retain your Personal Information for the length of time needed to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required for legal or business purposes. We may retain certain data as necessary to deter fraud or prevent future abuse, or for legitimate business purposes, such as account recovery, reporting and analysis of aggregated, non-personally-identifiable data, or if required by law.
Our basemap layers (such as aerial/satellite imagery and transportation) are provided by the Mapbox spatial data platform. By default, Mapbox collects anonymized usage statistics to inform their services and we agree to that purpose as part of our contractual obligation to them. Depending on your device and operating system (OS) capabilities, you may be able to elect to opt out of sending this data.
The security and confidentiality of your personal information are important to us. We have implemented technical, administrative, and physical security measures that are designed to protect Personal Information from unauthorized access, disclosure, use, and modification. We regularly review our security procedures to consider appropriate new technology and methods. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable.
Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of personal information we share with third parties or corporate affiliates for those third parties or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. Mapture, Inc.These Services are hosted in the United States and are intended primarily for users located within the United States. By using the Services and providing your information, you authorize us to collect, use, and store your information outside of your country of origin. Data privacy laws vary across jurisdictions, and different laws may be applicable to your data depending on where it is processed, stored, or used.
We may change this Privacy Policy from time to time. You should check back here periodically to see if the Privacy Policy has been updated. We will always show the date of the latest modification of the Privacy Policy at the top of the page so you can tell when it was last revised.
